Welcome to www.trfsq.com, The Rashidian Female Sexuality Questionnaire.  This website (the “Site”) is comprised of various web pages operated by: Heart to Heart Counseling, a California based partnership, founded in 2019. www.trfsq.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”), and of the TRFSQ Privacy Policy.  Please read these terms carefully and keep a copy of them for your reference.  BY USING THE SITE, YOU AGREE TO THESE TERMS AND CONDITIONS OF USE.  If you do not agree to be bound by this Agreement, please do not use the Site.

www.trfsq.com is a research-based website designed to show users different aspects of female sexuality and sexual health care challenges, plus enhancing communication between healthcare providers and female patients. 

The TRFSQ targets women, aged 18 years and above, who feel: i) that they may be unable to recognize that they may have a sexuality-related issue; ii) the need to share their physical and/or emotional sexual challenges, and /or iii) that they want to know more about their sexuality. Participation is voluntarily, and the women’s willingness to complete the questionnaire serves as their consent to participate, either online and or by downloading a PDF version of the questionnaire.  For all participants, no incentive will be provided. The online results are anonymous, and the researchers cannot identify individual women. The primary researcher, a licensed clinician, only has access to the online data collection.  

PRIVACY

Your use of http://www.trfsq.com is subject to its Privacy Policy, which also governs the Site, and informs users of its data collection practices, and is incorporated into these terms by this reference.

AGE OF USERS

This Site is not directed or targeted to children under the age of 18, and as such children under the age of 18 may not use http://www.trfsq.com or register for the products or services provided by or made available via its website.  

Parents or legal guardians of children under the age of 18 may not agree to these Terms on their behalf.  If the TRFSQ becomes aware that a child under the age of 18 has provided personal information to http://www.trfsq.com, TRFSQ will use its best efforts to remove this collected demographic information from its files.

ELECTRONIC COMMUNICATIONS

Visiting http://www.trfsq.com or sending emails, constitutes electronic communications. Its user consents to receive electronic communications and agrees that all agreements, notices, disclosures, and other communications that is provided to the users electronically via email and on the Site, satisfy any legal requirement that such communications be in writing.

It users will have access to the instrument online at the website https://trfsq.com, which can be used for clinical (professionally recommended) and non-clinical (Random selective participation) samples. Users can respond to questions online by providing their email address to receive a PDF version (without evaluation) of their responses. If they wish to receive an assessment, they may share their information with their healthcare provider. The online participation offers a spreadsheet, summary statistics (i.e., frequency table for each scale, pie chart, etc.) which will be used to further the research on women’s sexuality and sexual healthcare when data are compiled and collected from a large sample of women in the pilot study. From the website, instead of online participation, they may also choose to download a PDF copy of the questionnaire. Users may then complete it manually and share the content with their healthcare practitioners. In this case, no data will be available for our anticipated studies. There is no set timeframe to receive the questionnaire and responses. To answer all the questions will take approximately 10-15 minutes. There are no correct or incorrect answers.

CONFIDENTIALITY

Using this Site, you are agreeing with the following disclosure: 

“By completing and submitting the TRFSQ questionnaire, I hereby consent to my practitioner, to confidentially use this data as part of my treatment plan, and for TRFSQ to use the data anonymously for research purposes to improve the sexual wellness of women.”

NO UNLAWFUL OR PROHIBITED USE/INTELLECTUAL PROPERTY

The user is granted a non-exclusive, non-transferable, revocable, and limited license to access and use http://www.trfsq.com for their personal, non-commercial use strictly in accordance with these terms.  As a condition of their use of the Site, they warrant to TRFSQ that they will not use the Site for any purpose that is unlawful or prohibited by these terms. They may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. They may not obtain or attempt to obtain any materials or information through any means not intentionally made available orprovided for through the Site.

All content included as part of the service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of TRFSQ and protected by copyright, trademark and other laws that protect intellectual property and proprietary rights. The user agrees to observe and abide by all copyright, trademark and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

The user will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. trfsq.com content is not for resale. The use of this Site does not entitle the user to make any unauthorized use of any protected content, and in particular will not delete or alter any proprietary rights or attribution notices in any content. The user will use protected content solely for their personal use and will make no other use of the content without the express written permission of TRFSQ and the copyright owner. They agree that they do not acquire any ownership rights in any protected content. TRFSQ does not grant the user any licenses, express or implied, to the intellectual property of TRFSQ or its licensors except as expressly authorized by these Terms.

INTERNATIONAL USERS

The Service is controlled, operated, and administered by the TRFSQ from its offices within the USA. If user access the service from a location outside the USA, they are responsible for compliance with all local laws. Users agree that they will not use the TRFSQ Content accessed through http://www.trfsq.com in any country, or in any manner prohibited by any applicable laws, restrictions, or regulations.

INDEMNIFICATION

The user agree to indemnify, defend and hold harmless TRFSQ, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of their use of, or inability to use the Site or services, any user postings made by them, their violation of any terms of this Agreement, or their violation of any rights of a third party, or their violation of any applicable laws, rules or regulations. TRFSQ reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user, in which event they will fully cooperate with TRFSQ in asserting any available defenses.

LIABILITY DISCLAIMER

The information, software, products, and services included in, or available through the site, may include inaccuracies or typographical errors. changes are periodically added to the information herein. The TRFSQ and/or its suppliers may make improvements and/or changes in the site at any time.

The TRFSQ and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics, contained on the site for any purpose. to the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided “as is” without warranty or condition of any kind. The TRFSQ and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement.

To the maximum extent permitted by applicable law, in no event shall TRFSQ and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever. this includes, without limitation, damages for loss of use, data, or profits, arising out of, or in any way connected with the use or performance of the site, with the delay or inability to use the site, or related services. this also includes the provision of, or failure to provide services, or for any information, software or products, and related graphics obtained through the site, or otherwise arising out of the use of the site, whether based on contract, tort, negligence, strict liability or otherwise.  Even if the TRFSQ or any of its suppliers has been advised of the possibility of damages. because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to its users. if they are dissatisfied with any portion of the site. Its users are limited to their own sole and exclusive remedy, which is to discontinue using the site.

TERMINATION/ACCESS RESTRICTION

TRFSQ reserves the right, in its sole discretion, to terminate its users access to the Site and the related services or any portion thereof, at any time, without notice. To the maximum extent permitted by law, this agreement shall be governed by and construed in accordance with the laws of the State of California.  All disputes arising out of this agreement shall be resolved and adjudicated in the Federal and State Courts of California residing in the County of Los Angeles.  Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms, including, without limitation, this section.

The user agrees that no joint venture, partnership, employment, or agency relationship exists between them and the TRFSQ as a result of this agreement or use of the Site. The TRFSQ performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of TRFSQ’s right to comply with governmental, court and law enforcement requests or requirements relating to its users’ use of the Site, or information provided to or gathered by TRFSQ with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and TRFSQ with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and TRFSQ with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

CHANGES TO TERMS

The TRFSQ reserves the right, in its sole discretion, to change the Terms under which http://www.trfsq.com is offered. The most current version of the Terms will supersede all previous versions. TRFSQ encourages the user to periodically review the terms to stay informed of our updates.
